Limitation of Warranty and Liability on Goods

WHS Total Solutions Pty Ltd warrants that these goods will be free from defect in materials and workmanship for a period of 90 days only from the date of acquisition.  If such a defect occurs within 90 days, please contact WHS Total Solutions Pty Ltd via our website whstotalsolutions.com.au to arrange replacement.

Except for the express Warranty above, the software is provided on an "as is" basis, without any other warranties or conditions, express or implied, including, but not limited to, warranties or merchantable quality, satisfactory quality, merchantability, or fitness for a particular purpose, or those arising by Law, Statute, usage of trade, course of dealing or otherwise.  You assume the entire risk as to the results and performance of the product.

Neither WHS Total Solutions Pty Ltd or our dealers or suppliers shall have any liability to you or any other person or entity for any indirect, incidental, special, or consequential damages whatsoever, including, but not limited to, loss of revenue or profit, lost or damaged data or other commercial or economic loss, even if we have been advised of the possibility of such damages, or they are foreseeable.  We are also not responsible for any claims by a Third Party.  Our maximum aggregate liability to you and that of our dealers and suppliers shall not exceed the amount paid by you for the product.  The limitations in this section shall apply whether or not the alleged breach or default is a breach of fundamental condition or term or a fundamental breach.

All intellectual property included but not limited to know-how, concepts, copyright, inventions, patents, trademarks, and other proprietary rights in relation to WHS Total Solutions Pty Ltd products or processes, text, materials or work of any kind developed by WHS Total Solutions Pty Ltd shall be the sole property of WHS Total Solutions Pty Ltd as and when they are created.

The Purchaser of these goods may not use the goods or make copies of it except as permitted by WHS Total Solutions Pty Ltd.  The Purchaser must not translate, reverse engineer, decompile, or disassemble the goods except to the extent applicable law expressly prohibits the foregoing restriction.

The Purchaser may not rent, lease assign, transfer, modify, merge all or any part of the goods with another, redistribute any documents, graphics, tables, forms, reports, queries, macros, code, data files, etc. included in the goods.

The Purchaser may not separate any component parts of the goods for use on more than one computer.

By using this material, the Purchaser agrees to the above.

The Laws of Western Australia govern this agreement.
